AirCycler Privacy Policy
This Privacy Policy (“Policy”) describes the privacy practices applicable to this mobile app (the “App”) operated by Lipidex Corporation (“we” or “our”). The App is designed to be connected to and provide certain functions for some products sold by us at https://www.aircycler.com/collections (“Products”). The Policy explains how personal information about you may be collected, used, and disclosed by us.
1. INFORMATION WE COLLECT
We collect and receive Personal Information and other information about you in connection with the App. Personal Information means information relating to an identified or identifiable natural person. Personal Information does not include information that has been deidentified, pseudonymized or anonymized to the extent permitted by applicable law.
• Registration. When you download and register to use the Mobile App, you will provide Personal Information and other information about yourself, including your name, zip code (optional), email address, and telephone number.
• Account Credentials. When you register to use the App, we may collect your account information, such as username and password.
• Products Information. We will collect information about the Products, including product type, software version, serial numbers and location where they are installed. The App will collect information from the Products, such as air quality data readings, ventilation operations, energy consumption data and other technical data collected by the Products.
• Contacting Us about the App. When you contact us about or through the App, you may provide Personal Information and other information about yourself, such as your name, postal address, email address, and telephone number. For example, you may provide Personal Information by sending us an email, filling out contact forms or calling us about the App.
• Device and Browser Information. When you use the App, we may collect information, such as the type of browser and operating system you are using, the domain name of your Internet service provider, which pages you visit or functions you use and how long you spend on each, and the unique number (such as IP address) assigned to your server or Internet connection.
• Service Providers. We collect Personal Information and other information about individuals associated with service providers that we engage to provide us services related to the App, such as name, postal address, email address, telephone number, company name and title.
• Other Information. We may obtain Personal Information about you from third parties, including entities that direct you to or are accessible via the App, and business partners.
2. USES AND PURPOSES OF INFORMATION
We use Personal Information and other information for the purposes described below.
• To provide the functionality and features of the App
• To create and manage your account on the App
• To communicate with you, including responding to your email or telephone inquiries
• To fulfill your requests made on the App and through other interactions with us
• To provide technical support for the App
• To improve the functionality, customization, personalization, security, design and/or content of the App
• To conduct usage analytics, including analyzing usage and patterns on the App
• To aggregate and/or deidentify information from you and other users of the App
• To develop new products and services
• To provide marketing materials we believe would be of interest to you, to maintain and update your contact preferences and to add you to our databases for future marketing purposes
• To administer, fulfill and enforce contractual obligations
• For compliance purposes and legal obligations, such as complying with legal and regulatory requirements, protecting and defending us and our affiliates against legal actions or claims, and preventing fraud
3. DISCLOSURE OF PERSONAL INFORMATION
Your Personal Information and other information may be shared with third parties as follows:
• Your Personal Information and other information may be shared with third parties that we engage to provide services to us. We may also provide your Personal Information and other information to third parties that assist with the operation or maintenance of the App, that provide us with analytic services, and other functions. These third parties are authorized to use your Personal Information only as necessary to provide the services to us.
• Your Personal Information, such as name and zip code, and other information, such as the system settings of your Products, may be shared with installation, maintenance and service providers in order to facilitate the services they provide for you and your Products.
• We may share with third parties information that has been deidentified or anonymized such that the third party cannot personally identify you from the information we share. For example, we may share air quality readings collected through the App with third parties.
• We may share or transfer your information if we enter into a business transaction such as a merger, acquisition, reorganization, bankruptcy, or sale of some or all of our assets, or in preparation for any of these events.
• We may disclose your information if we believe that the App is being used to commit unlawful acts; if disclosure of your information is required to comply with applicable laws or regulations or with a court or administrative order or will help to enforce any applicable terms of use; to protect your safety or security, including the safety and security of property that belongs to you; or to protect the safety and security of the App or third parties.
• We may share your Personal Information with other parties based on your consent.
4. COOKIES AND SIMILAR TECHNOLOGIES.
When you visit the App, we may place, or authorize third parties to place, cookies, web beacons, HTML5, Flash Local Storage and other tracking technologies on your device. Cookies are small files of information that are stored on your device. Web beacons are used to transmit information collected through cookies to servers. These technologies may help the App operate more efficiently and improve your experience with the App by performing functions like allowing the App to recognize you. We may also use these technologies for analytical purposes, such as counting how many unique visitors have accessed the App. You may adjust your device settings to block or manage some of these technologies if they are deployed on the App. However, doing so could limit some functionalities of the App. The App does not respond to “Do Not Track” or other automated signals.
5. MINORS
You must be at least 18 years old, or the age of majority to enter into a contract, whichever is older, to use the App. However, if you become aware that we have collected Personal Information from a minor without your consent and you are the minor’s parent or guardian, please notify us at support@aircycler,com and we will delete their Personal Information from our records.
6. YOUR RIGHTS AND CHOICES
• Delete or Update Your Personal Information. You may request that we delete your Personal Information or rectify your inaccurate Personal Information by emailing us at support@aircycler.com. The App will no longer be operable if your Personal Information is deleted. We may ask you to verify your identity before responding to any requests. We may deny or limit the response to requests where we are unable to verify your identity or we suspect fraudulent or malicious activity.
• Opt-Out of Marketing. If you wish to opt-out of receiving marketing solicitations from us, please contact us at support@aircycler.com. Even if you opt-out, we may still use and share the information we collect for non-marketing purposes.
• Unsubscribe from Emails. Our marketing emails will include an automated way for you to opt-out (unsubscribe) from marketing emails sent by us. To unsubscribe, please follow the instructions in the email you receive.
7. UNITED STATES POLICY
The App is intended only for use in the United States. This Policy describes our information practices in the United States. Information that is processed in jurisdictions outside of the United States may be disclosed or transferred to the United States or other locations. We make no representation that the practices described in this Policy are compliant with laws outside of the United States that apply to the collection, security, use and disclosure of information. When information is transferred to the United States, it will be handled in accordance with the laws of the United States.
8. DATA RETENTION
We will retain your Personal Information for as long as necessary to provide the functionality and features of the App; provide any information you request; as necessary for the performance of legal agreements; to comply with legal obligations, including document preservation practices; to resolve disputes; during applicable statutes of limitations; in accordance with our internal document retention policy; and for other legitimate purposes.
9. SECURITY
Although we employ technical and organizational controls that we believe are reasonably appropriate to protect your information, we do not guarantee that our security precautions will protect against the loss or misuse of your information. Similarly, we cannot guarantee the privacy of information you transmit over the Internet or that may be collected in transit by others, including contractors that provide services to us.
10. OTHER WEBSITES AND LINKS
The App may contain links to other websites. We are not responsible for the information collection or privacy practices of other websites. You should consult the privacy policies of other sites before you visit those sites or provide any information to those sites.
11. REVISIONS TO THIS POLICY
We reserve the right to revise this Policy at any time. Please review this Policy periodically for changes and at any time you provide information to us. We will post any revised versions of the Policy on the App. We will also notify you if we make material changes to the Policy by posting a notice on the App or contacting you by other methods. By continuing to access or use the App after changes become effective, you agree to be bound by the terms of the revised Policy.
